LANSING, Mich. — The city of Flint has accused the state of Michigan of "grossly negligent oversight" and notified officials it may sue over the lead contamination of the city's drinking water, in a move that took state officials by surprise.
A spokesman for Gov. Rick Snyder said the legal filing could complicate efforts to fix problems in Flint. City Attorney Stacy Erwin Oakes said Flint still hopes to establish a cooperative relationship with the state and avoid a lawsuit, but the move was needed to protect the interests of city taxpayers.
In a letter to the Michigan Court of Claims giving formal notice of the intent to sue, Flint Mayor Karen Weaver said Flint switched its drinking water source to the Flint River in April 2014 after relying on authorizations and directions from the Michigan Department of Environmental Quality.
The city later learned the directions from the Department of Environmental Quality were "contrary to applicable EPA laws and regulations," the letter said.
"As a direct and proximate result, the city has suffered or will suffer damage to its municipal water distribution system, emergency response costs arising out of the declaration of a state of emergency, attendant ongoing medical claims, lowered property values resulting in lower tax assessments, reputational damage," and other damages, Weaver says in the March 24 letter.

Copies of the letter also were sent to the state attorney general and the<span style="color: Red;">*</span>Department of Environmental Quality, which also is named as a potential defendant.
Ari Adler, a spokesman for Snyder said "the mayor’s office did not tell the governor’s office this was going to be happening, even though key members of the Snyder administration talk daily with key members of the Weaver administration."
Also, "once the city sues the state, communicating officially will be much more difficult as every conversation will need to involve questions about whether or not lawyers need to be present. And, of course, an open dialogue is more difficult with anyone who has decided to take you to court rather than work together as partners to solve a problem."

Oakes said the notice does not mean that Flint will necessarily sue the state. But under the law, the city has only 180 days from the time it becomes aware it may have a claim against the state to file such a notice, and that clock was running out when the notice was filed. The city wants a good working relationship with the state but has incurred additional costs resulting from the water problem that the state, not the city, should have to bear, she said.
Flint's drinking water became contaminated with lead in April 2014, when the city, while under the control of a state-appointed emergency manager, switched its drinking water source from Lake Huron water treated by the Detroit water system to Flint River water treated at the Flint water treatment plant.
The state Department of Environmental Quality failed to require the addition of needed corrosion-control chemicals as part of the treatment process, and the corrosive Flint River water ate into pipes, joints and fixtures, sending unsafe levels of lead into Flint homes and businesses. The city returned to the Detroit water system in October, but a potential hazard remains because of damage done to the water distribution system.
